Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and FlowTester ("Company," "we," "us," or "our"), governing your access to and use of the FlowTester platform, website, APIs, and all related services (collectively, the "Service") available at flowtester.ai.

By creating an account, accessing, or using the Service, you represent and warrant that you have the legal capacity to enter into these Terms and that you agree to be bound by them. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" and "your" shall refer to both you individually and the organization.

If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service following any modifications to these Terms constitutes acceptance of such modifications.

2. Description of Service

FlowTester is an AI agent testing platform that enables users to test how AI agents interact with websites across different large language models (LLMs). The Service includes, but is not limited to, the following capabilities:

  • Writing and executing test instructions in natural language against target websites using AI agents powered by various LLM providers.
  • Viewing live video feeds and synchronized action logs of AI agent browser sessions for real-time debugging.
  • Creating and managing test suites to organize multiple related tests.
  • Connecting GitHub or GitLab repositories to trigger automated test runs based on push or deployment events via webhooks.
  • Creating and managing multiple projects within an organization.
  • Managing team members with role-based access controls and permissions.
  • Generating structured test reports including pass/fail results, detected issues, and optimization recommendations.

FlowTester reserves the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Account Registration and Management

3.1 Account Creation

To use the Service, you must create an account by providing accurate, current, and complete information. You may register using an email address and password or through a supported third-party authentication provider (such as GitHub or GitLab). You agree to update your information promptly to keep it accurate and complete.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify FlowTester of any unauthorized use of your account or any other breach of security. FlowTester shall not be liable for any loss or damage arising from your failure to protect your account credentials.

3.3 Organizations and Teams

If you create an organization on FlowTester, you are the organizational administrator and are responsible for managing team members, assigning roles and permissions, and ensuring that all users within your organization comply with these Terms. Organizational administrators may have visibility into the usage data, test results, and account activity of team members within their organization.

3.4 Account Eligibility

The Service is intended for use by individuals who are at least 16 years of age. By creating an account, you represent and warrant that you are at least 16 years old. If we learn that an account has been created by a person under the age of 16, we will terminate that account immediately.

4. Credits, Billing, and Payment

4.1 Credit-Based Pricing

FlowTester operates on a usage-based credit model. You purchase credits in advance, and credits are consumed only when tests are executed. We do not charge per seat or per user. The current credit pricing and consumption rates are published on the Service and may be updated from time to time.

4.2 Purchases and Payments

All credit purchases are processed through our third-party payment provider. By purchasing credits, you agree to provide accurate and complete billing information and authorize us to charge the applicable amount to your designated payment method. All prices are displayed in the currency specified on the Service and are exclusive of applicable taxes unless otherwise stated.

4.3 Refund Policy

Purchased credits are non-refundable except where required by applicable law. Unused credits do not expire for as long as your account remains active. If your account is terminated for violation of these Terms, any remaining credits are forfeited. In the event of a Service discontinuation, we will provide a pro-rata refund for unused credits.

4.4 Free Tier and Trials

FlowTester may offer free credits, trial periods, or promotional offers at its discretion. Free or promotional credits may be subject to additional terms, usage limitations, or expiration dates as specified at the time of the offer. FlowTester reserves the right to modify or discontinue any free tier or promotional offer at any time.

5. Acceptable Use

5.1 Permitted Use

You may use the Service solely for lawful purposes and in accordance with these Terms. The Service is designed for testing how AI agents interact with websites, debugging agent behavior, and optimizing websites for AI agent compatibility.

5.2 Prohibited Conduct

You agree not to use the Service to:

  1. Test websites or web applications that you do not own or do not have explicit authorization to test.
  2. Conduct any form of unauthorized penetration testing, vulnerability scanning, or security testing against third-party websites without their express written consent.
  3. Engage in any activity that violates the terms of service of any third-party website being tested.
  4. Scrape, harvest, or systematically collect data from third-party websites for purposes unrelated to legitimate agent interaction testing.
  5. Attempt to gain unauthorized access to any systems, networks, or accounts, whether belonging to FlowTester or any third party.
  6. Distribute malware, viruses, or any other harmful or malicious code through the Service.
  7. Use the Service to engage in any form of fraud, phishing, social engineering, or deceptive practices.
  8. Circumvent, disable, or interfere with any security, rate-limiting, or access control features of the Service.
  9. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
  10. Use the Service in a manner that could damage, overburden, or impair the Service or interfere with any other party's use of the Service.
  11. Resell, sublicense, or commercially redistribute access to the Service or any outputs generated by the Service without our prior written consent.
  12. Use the Service to generate, store, or transmit content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
  13. Use the Service to test websites in a manner that processes personal data of third parties in violation of applicable data protection laws.
  14. Create multiple accounts to circumvent usage limits, abuse promotional offers, or evade enforcement of these Terms.

5.3 Enforcement

FlowTester reserves the right to investigate and take appropriate action against any violation of these Terms, including but not limited to suspending or terminating your account, removing content, reporting illegal activities to law enforcement authorities, and pursuing legal remedies. We may, at our sole discretion, determine whether conduct constitutes a violation of these Terms.

6. Intellectual Property

6.1 FlowTester Intellectual Property

The Service, including all software, algorithms, user interfaces, designs, text, graphics, logos, trademarks, and other content provided by FlowTester, is the exclusive property of FlowTester or its licensors and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service or any FlowTester intellectual property except for the limited license to use the Service as expressly provided herein.

6.2 Your Content

You retain ownership of any content you create, upload, or submit through the Service, including test instructions, test suite configurations, and project settings ("User Content"). By submitting User Content to the Service, you grant FlowTester a non-exclusive, worldwide, royalty-free license to use, process, store, and display your User Content solely as necessary to provide, maintain, and improve the Service. This license terminates when you delete your User Content or your account, except to the extent necessary for FlowTester to comply with legal obligations or maintain backup copies for a reasonable period.

6.3 Test Outputs

Test results, reports, video recordings, action logs, and AI agent readiness scores generated through the Service ("Test Outputs") are provided to you for your use. You may use, copy, and distribute Test Outputs for your internal business purposes. FlowTester may use anonymized and aggregated Test Output data to improve the Service, develop new features, and generate industry benchmarks, provided that such use does not identify you or your organization.

6.4 Feedback

If you provide FlowTester with suggestions, ideas, improvements, or other feedback regarding the Service ("Feedback"), you hereby assign to FlowTester all right, title, and interest in such Feedback. FlowTester may use, implement, and commercialize Feedback without restriction, obligation, or compensation to you.

7. Third-Party Services and Integrations

7.1 AI Model Providers

The Service enables you to execute tests using AI models provided by third-party providers, including but not limited to OpenAI, Google, Anthropic, and others. When you select an AI model, your test instructions are transmitted to the relevant provider for processing. Your use of third-party AI models is subject to the respective provider's terms of service and privacy policy. FlowTester is not responsible for the performance, accuracy, availability, or outputs of any third-party AI model.

7.2 Repository Integrations

The Service allows you to connect GitHub or GitLab repositories to trigger automated test runs. By connecting a repository, you authorize FlowTester to receive webhook events related to push and deployment activities. FlowTester does not access, read, or store your source code. You are responsible for ensuring that your use of repository integrations complies with the terms of service of the applicable repository hosting provider.

7.3 Third-Party Websites

FlowTester executes AI agent interactions on third-party websites as directed by your test instructions. You are solely responsible for ensuring that you have authorization to test any third-party website and that your testing activities comply with the target website's terms of service, robots.txt directives, and all applicable laws. FlowTester does not endorse, control, or assume responsibility for any third-party website.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. The Privacy Policy describes how we collect, use, and protect your personal information and is incorporated into these Terms by reference.

All data associated with your account, including test data, test results, video recordings, action logs, and all other information, is retained for the entire duration that your account remains active. Upon account deletion, data will be handled as described in our Privacy Policy.

9. Disclaimers

9.1 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLOWTESTER EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, AND QUIET ENJOYMENT.

9.2 No Guarantee of Results

FlowTester does not warrant or guarantee that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) the results obtained through the Service, including test reports, AI agent readiness scores, and optimization recommendations, will be accurate, reliable, or complete; (c) any defects in the Service will be corrected; or (d) the Service will meet your specific requirements or expectations.

9.3 AI Output Disclaimer

Test results, optimization recommendations, and AI agent readiness scores are generated using artificial intelligence models and automated analysis. These outputs are provided for informational purposes only and do not constitute professional, legal, security, or technical advice. You acknowledge that AI-generated outputs may contain errors, inaccuracies, or omissions, and you are solely responsible for evaluating and relying upon such outputs. FlowTester shall not be liable for any decisions made or actions taken based on AI-generated outputs.

9.4 Third-Party Disclaimer

FlowTester is not responsible for the content, functionality, availability, security, or practices of any third-party websites tested through the Service, any third-party AI model providers, or any other third-party services integrated with the Service. Any interactions with third parties are solely between you and the third party.

10. Limitation of Liability

10.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FLOWTESTER, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND WHETHER OR NOT FLOWTESTER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10.2 Cap on Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF FLOWTESTER FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU HAVE PAID TO FLOWTESTER IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED EUROS (€100). THIS LIMITATION APPLIES REGARDLESS OF THE FORM OF ACTION OR THEORY OF LIABILITY.

10.3 Essential Purpose

THE LIMITATIONS AND EXCLUSIONS IN THIS SECTION APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND SHALL APPLY EVEN IF ANY LIMITED REMEDY SPECIFIED IN THESE TERMS IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

11. Indemnification

You agree to indemnify, defend, and hold harmless FlowTester, its directors, officers, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party, including intellectual property rights, privacy rights, or terms of service of any third-party website; (d) your User Content; (e) any unauthorized testing of third-party websites conducted through your account; or (f) your negligence or willful misconduct.

FlowTester reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.

12. Term and Termination

12.1 Term

These Terms are effective from the date you first access or use the Service and continue until terminated in accordance with this Section.

12.2 Termination by You

You may terminate your account at any time by contacting us at support@flowtester.ai or through the account settings in the Service. Upon termination, your right to use the Service will cease immediately.

12.3 Termination by FlowTester

FlowTester may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to: (a) violation of these Terms or any applicable law; (b) conduct that we determine, in our sole discretion, is harmful to other users, third parties, or the business interests of FlowTester; (c) extended periods of inactivity; or (d) non-payment of amounts owed.

12.4 Effects of Termination

Upon termination of your account: (a) your license to use the Service terminates immediately; (b) you must cease all use of the Service; (c) any remaining unused credits are forfeited unless the termination is by FlowTester without cause, in which case a pro-rata refund of unused credits will be provided; (d) your data will be handled in accordance with our Privacy Policy. Sections 5, 6, 9, 10, 11, 13, 14, and 15 shall survive termination of these Terms.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of laws principles.

13.2 Informal Resolution

Before initiating any formal dispute resolution proceedings, you agree to first contact FlowTester at legal@flowtester.ai and attempt to resolve any dispute informally for a period of at least thirty (30) days. Most disputes can be resolved through good faith negotiation.

13.3 Jurisdiction

If a dispute cannot be resolved informally, you agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the competent courts of Amsterdam, the Netherlands. You consent to the personal jurisdiction of such courts and waive any objection to venue therein.

13.4 Class Action Waiver

To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action or class-wide arbitration.

14. General Provisions

14.1 Modifications to Terms

FlowTester reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service, updating the "Last Updated" date, and sending notice to the email address associated with your account. Your continued use of the Service after the effective date of any modifications constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and terminate your account.

14.2 Entire Agreement

These Terms, together with the Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and FlowTester with respect to your use of the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.

14.3 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

14.4 Waiver

The failure of FlowTester to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by FlowTester.

14.5 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. FlowTester may assign or transfer its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.

14.6 Force Majeure

FlowTester shall not be liable for any failure or delay in performing its obligations under these Terms resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemics, government actions, war, terrorism, cyberattacks, power outages, telecommunications failures, or failures of third-party service providers.

14.7 Notices

All notices from FlowTester to you will be sent to the email address associated with your account or posted on the Service. All notices from you to FlowTester should be sent to legal@flowtester.ai. Notices shall be deemed received upon delivery via email or upon posting on the Service.

14.8 No Third-Party Beneficiaries

These Terms are for the sole benefit of you and FlowTester. Nothing in these Terms, express or implied, is intended to or shall confer upon any third party any right, benefit, or remedy.

15. Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations, including the EU Dual-Use Regulation, U.S. Export Administration Regulations, and any other applicable trade compliance laws. You represent and warrant that you are not located in, under the control of, or a national or resident of any country or territory subject to comprehensive trade sanctions, and that you are not designated on any restricted party list.
